  • Agreements

    Definition: an international agreement is a formal expression that regulates partnerships between UCAB and an organism, institution or foreign university for the development of joint activities in areas related to the purpose of both institutions.

    Objective: the main objective of an international agreement subscription is to formalize mutual collaboration as a framework for promoting projects that add value to the internationalization process of UCAB in all aspects: teaching, research, extension, service, and university management. Therefore it is important for these agreements to have a mutual benefit relationship during the entire period of validity.

    Classification: there are two types of institutional agreements. First, general agreements, also called framework agreements; and, second, specific agreements, also called addenda or reference terms. In practical terms, it is expected that every international partnership formally developed, allows signing a general agreement and as many specific agreements as projects intended to achieve through each alliance.

    Framework agreement: it establishes the fundamental elements of a partnership and defines the collaboration fields. A typical framework agreement includes the following sections: introduction of the parties; explanatory statement; clauses: object, development, monitoring, term and termination, funding, promotion of actions, confidentiality, prohibition of assignment, legal terms and resolution of controversies; signatures.

    Specific agreement: it defines a specific course of actions, within a framework agreement, and describes the resources, mechanisms, and procedures for its development and closure. A typical specific agreement includes the following sections: introduction of the parties; reference to the framework agreement; clauses for student exchange: number of students, period of exchange, requirements, selection of candidates, exemption from tuition, Other financial commitments, System of the receiving institution, Recognition of credits; clauses for faculty exchange: Number of faculty members and exchange period, Requirements, Working conditions, Economic commitments, Duties and responsibilities; other clauses: term, modification, renewal and termination of agreement, responsible; signatures.

    1. The interested person, department or institution, within the university or overseas, must complete the agreement application form which can be found on the webpage of the Secretariat of International Relations. This form must be submitted along with the following: Institution's background information and justification of the agreement (benefits and advantages resulting from this partnership). Supports of legitimacy of the institution and its legal representative (constitutive act, internal regulations, authorization of signatory for committing the institution, identification document of legal representative)
    2. This information will be presented by the Secretariat of International Relations to the Academic Council of UCAB to be discussed and approved. The international agreements requiring economic resources that are not included on UCAB regular budget will require also the approval of the Administrative Council.
    3. Once approved by the Academic Council, the Secretariat of International Relations will prepare the drafts for the framework and specific agreements and will submit these to the counterpart. Once the suggestions from the counterpart are incorporated, the agreements will be referred to UCAB Legal Advisor Office. If there are corrections from the Legal Advisor it will be notified to the counterpart and, if necessary, renegotiated. These agreements will be ready for the University President's signature once both institutions agree to all terms.
    4. Once the framework and specific agreements are signed and stamped by the University President of UCAB in duplicate, these are sent to the counterpart of its signature. Then, the counterpart sends back to UCAB one of each original agreement already signed and stamped by their legal representative. The UCAB Secretariat of International Relations will scanned the received documents and will send this digital files to the General Secretariat and the academic and/or administrative units responsible for the development of the partnership activities. The original documents will be filed by the Legal Advisor Office.
